LAGA M23 ("Implementation Aid for the Disposal of Asbestos-Containing Waste") regulates the disposal of asbestos-containing waste. A new version, dated November 29, 2023, is now available. It will be gradually introduced by the individual states, with country-specific modifications possible.
This results in significant changes for the disposal of construction debris: All buildings constructed before 1994 are generally considered to be potentially asbestos-contaminated.
Prior to any construction interventions, such as demolition, renovation, or maintenance, in buildings where construction began before October 31, 1993, and for which there is no proof of asbestos-free status due to a previous asbestos remediation, a specific investigation for the pollutant asbestos is required. This requirement arises from the provisions of the KrWG, the GefStoffV, the Construction Site Ordinance (BaustellV), and the respective state building regulations. Implementation is specified by the guidelines of VDI 6202 Part 3.

If this is not done, or if identified asbestos-containing materials are not completely separated before demolition based on a deconstruction plan, the resulting construction debris must be disposed of as hazardous waste at very high costs.
